Privacy and cookies policy DZIECIOKRACJA.PL
Article 1 Preliminary provisions
- The Privacy and Cookies Policy defines the terms and conditions of processing personal data of users (hereinafter: "Users") visiting the pages of the Internet service available in the domain WWW.DZIECIOKRACJA.PL (hereinafter: "DZIECIOKRACJA.PL") and the use of cookies or other similar technologies within DZIECIOKRACJA.PL.
2. The administrator of the personal data is the owner of DZIECIOKRACJA.PL Soltermo sp z o.o. with its seat in Dzierżoniów, ul Świdnicka 24, postal code 58-200, registered in the National Court Register kept by the District Court for Wroclaw-Fabryczna, IX Economic Department, under KRS number: 0000848927, NIP: 8822135397, REGON: 38647342300000 (hereinafter: "Administrator").
- The Administrator has appointed a Data Protection Supervisor - r.pr. Anna Wrona, who can be contacted by email at: iod@DZIECIOKRACJA.pl or by postal mail (address indicated in paragraph 2).
- The Administrator shall respond to any questions or requests regarding the processing of personal data, including the Privacy Policy and cookies.
- The Administrator attaches great importance to the protection of privacy and confidentiality of personal data entered or provided by Users, and with due diligence selects and applies appropriate technical and organizational measures to ensure the protection of the processed personal data.
- The Administrator protects personal data from being made available to unauthorized persons, as well as from being processed in violation of applicable laws.
Article 2 Processing of personal data - use of DZIECIOKRACJA.PL
- The users visiting DZIECIOKRACJA.PL may browse the DZIECIOKRACJA.PL Internet pages without previous registration and giving personal data.
- The user, regardless of his/her status as a Buyer or Seller, gives his/her personal data in connection with:
- registration in DZIECIOKRACJA.PL
- use of services within the framework of DZIECIOKRACJA.PL,
- The scope of personal data processed by DZIECIOKRACJA.PL may differ depending on what services or functionality the User uses.
- The User is obliged to constantly update all data if any changes occur in any scope.
- The User may also register and log in to DZIECIOKRACJA.PL using the name (login) and access password within the framework of other Internet services (Facebook and Google), which provide such a possibility and have been functionally connected to DZIECIOKRACJA.PL. The data transferred and collected in this way at DZIECIOKRACJA.PL are treated as data submitted by the User for registration at DZIECIOKRACJA.PL.
- As a result of correct registration, the User is given access to a set of resources created for him/her (hereinafter referred to as: "Account"), which he/she can use within DZIECIOKRACJA.PL after providing the e-mail address reported during registration and the password or login data in the services indicated in paragraph 3 above.
- The user should not provide the Administrator with personal data of third parties. If he/she provides such data, however, each time he/she declares that he/she has the appropriate consent of the third parties for providing the data to the Administrator.
- The Account contains the data given by the User and the history of his/her activity within DZIECIOKRACJA.PL. In case of any changes of the data entered in the Account, the User is obliged to update them immediately, using the appropriate form available on the Internet pages in the domain DZIECIOKRACJA.PL. The user is responsible for the consequences of providing or maintaining incomplete, outdated or false data.
- The e-mail address and password given during registration are used for logging in. The user is not allowed to share the possibility of using the Account with other people, including revealing the password used to access the Account. The User is obliged to keep the password to the Account secret and protect it from disclosure. The user is obliged to immediately inform the Administrator if the access data to the Account has been intercepted by third parties and explain the circumstances of their interception.
- Provision of personal data is voluntary, but failure to provide the data may hinder or prevent the User from using the services within DZIECIOKRACJA.PL correctly
Article 3 Basis for processing personal data at DZIECIOKRACJA.PL
- Personal data are processed by the Administrator in accordance with the provisions of the law, including in particular the Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016 on the protection of individuals with regard to the processing of personal data and on the free flow of such data and the repeal of Directive 95/46/EC (hereinafter referred to as "RODO") exclusively for the purposes related to its activities, i.e. for:
- perform activities related to the conclusion and execution of the contract under the terms of the Rules and Regulations for Buyers or the Rules and Regulations for Sellers (based on Article 6(1)(b) of the RODO), in particular:
- to undertake activities related to the handling of registration/logging in by the User, including through external authentication services available at DZIECRACJA.PL, such as. Facebook Connect, Google,
- provision of services by electronic means in connection with handling of the User's Account,
- provision of services by electronic means in connection with handling of sales contracts executed by the Users through DZIECIOKRACJA.PL,
- contacting the Users in the scope related to the provided services,
- ensuring safety of traffic on DZIECIOKRACJA.PL, counteracting abuse, fraud,
- to take action before concluding a contract, in particular to provide an offer at the request of the data subject;
- to establish commercial relations, including providing answers to the questions asked in connection with the Users' contact (on the basis of Article 6(1)(f) of the RODO in connection with the realization of the Administrator's legally justified interests consisting in responding to directed inquiries)
- realization of the newsletter delivery service under the terms of the Terms and Conditions for Buyers or the Terms and Conditions for Sellers (based on Article 6(1)(b) of the RODO);
- to carry out activities related to buyer protection from transactions through DZIECRACJA.PL, including compensation payments (on the basis of Article 6, paragraph 1, letter b RODO);
- fulfillment of the Administrator's legal obligation concerning tax and accounting obligations (on the basis of Article 6(1)(c) RODO in connection with tax and accounting regulations);
- handling complaints (on the basis of Article 6(1)(f) of the RODO in connection with the realization of the Administrator's legitimate interests concerning the protection of the Administrator's and the User's rights);
- realization of communication connected with the order executed for the User, in particular concerning informing the User about the possibility of creating an Account on DZIECIOKRACJA.PL on the basis of art. 6 section 1 letter f RODO in connection with the Administrator's legally justified interests consisting in taking care of the Administrator's interests and promoting DZIECIOKRACJA.PL;
- carrying out activities in the scope of enabling participation in the loyalty program (on the basis of Article 6.1.b RODO);
- marketing of the Administrator's own or third-party products or services, including the display of contextual or behavioral advertising, contacting Users, enabling participation in contests, promotional actions (on the basis of Article 6(1)(f) RODO in connection with the realization of the Administrator's legally justified interests consisting in taking care of the Administrator's interests and promoting DZIECIOKRACJA.PL's goods or services);
- asserting or securing claims or defending against them (on the basis of Article 6(1)(f) RODO in connection with the realization of the Administrator's legally justified interests concerning the protection of the Administrator's and the User's rights);
- to carry out statistical and analytical activities, including activity analysis, traffic management on DZIECRACJA.PL (on the basis of Article 6(1)(f) RODO in connection with realization of the Administrator's legally justified interests concerning optimization within DZIECRACJA.PL).
- perform activities related to the conclusion and execution of the contract under the terms of the Rules and Regulations for Buyers or the Rules and Regulations for Sellers (based on Article 6(1)(b) of the RODO), in particular:
Article 4 Principles of data processing at DZIECIOKRACJA.PL
- The Administrator processes personal data only to the extent necessary to fulfill the purposes for which they are collected. The purposes of collecting Users' personal data are clearly defined, having a basis in the law. The Administrator does not process personal data in a manner incompatible with these purposes.
- The Administrator shall exercise the rights of Users regarding their personal data in accordance with the law, including ensuring the accuracy of Users' personal data and responding promptly to any requests for rectification or updating of data.
- The Administrator limits the storage of personal data in accordance with the law, only to the period necessary for the purposes for which they are collected, unless there are legitimate reasons that allow for an extension of the data storage period.
- If personal data is shared with other entities, this shall be done in a secure, contractually secured manner or otherwise in accordance with applicable laws.
- The Administrator shall ensure that personal data is processed by him/her in a secure manner that ensures that only authorized persons have access to the data and only to the extent that it is necessary due to their activities.
Article 5 Rights of personal data subjects
- Each User whose personal data is processed by the Administrator has the right:
- access to the content of his/her data and obtain a copy of it;
- rectification of personal data;
- to limit the processing of personal data;
- deletion of personal data;
- data portability;
- the right to object to the processing of your data on the basis of the legitimate interest of the Administrator or to the processing for direct marketing purposes;
- the right to withdraw consent at any time without affecting the lawfulness of the processing.
- The Administrator will cease processing personal data and delete the data, unless the law requires further processing.
- The exercise of the rights referred to in the paragraph above shall be exercised by allowing you to contact the Administrator in the manner indicated in Article 1, paragraph 3 hereof.
- You have the right to lodge a complaint with a supervisory authority if you consider that the processing of personal data by the Administrator violates the law.
Article 6 Recipients of personal data
- User data may be transferred to entities entitled to receive them under applicable laws, including the competent judicial authorities.
- The User's personal data are made available to another User that is the other party to the contract of sale of goods, which is concluded through DZIECIOKRACJA.PL. The Seller, after obtaining from the Administrator personal data of the User purchasing goods using DZIECIOKRACJA.PL, is obliged to fulfill towards such User all obligations resulting from RODO and other legal regulations, including ensuring that the User realizes his/her rights on the grounds of RODO.
- Personal data may also be transferred to trusted recipients such as: payment operator, postal operators, couriers, accounting service provider, partners providing technical services (development and maintenance of IT systems and websites, analytical services), marketing agencies, debt collection companies, law firms.
- Personal data may be transferred to a third country/international organization if required or related to the services used by the User within the framework of DZIECRACJA.PL. If, as part of the processing, personal data will be transferred to recipients in third countries, such transfers will take place on the basis of an adequacy decision taken by the European Commission, or on the basis of standard contractual clauses in accordance with a decision of the European Commission, or on another legal basis for example: the express consent of the data subject.

Article 7 Storage period and other provisions
- Personal data processed for the purpose of executing a contract will be kept for the duration of the contract, and thereafter for the period necessary to secure or assert possible claims or to fulfill the Administrator's legal obligation (under tax or accounting regulations), also for the time necessary to comply with the law.
- Personal data processed on the basis of legitimate legal interest will be kept for the period of fulfillment of the purpose or objection or change of scope by the data subject.
- If personal data is processed on the basis of a separate consent, it will be kept until the consent is revoked.
- The Administrator may process personal data by automated means, including profiling, however, automated processing will not lead to decisions that produce legal effects or similarly significantly affect the situation of Users. This processing may affect the selection of advertisements displayed, or the selection of products, services offered. Users may receive special offers via individualized e-mail or Internet advertising.
- The Administrator does not process personal data in a way that would involve making solely automated decisions about the User.
- The Administrator uses IP addresses collected during Internet connections only for technical purposes related to server administration. In addition, IP addresses are used to collect general, statistical demographic information (e.g., about the region from which the connection is made).
Article 8 Cookies or similar technologies
- The Administrator uses cookies or similar technologies (hereinafter collectively referred to as "cookies") by which we mean IT data, in particular text files and stored in the Users' terminal equipment, intended for the functionality of the DZIECIOKRACJA.PL websites - e.g. remembering data and saving browsing preferences. The purpose of cookies is to facilitate browsing the resources of the website on subsequent visits.
- The Administrator uses its own cookies and those provided by third parties ("Trusted Partners"). The current List of Trusted Partners is available on the DZIECIOKRACJA.PL website. At any time the User may review the privacy policies of the Trusted Partners. References to these policies are located within DZIECIOKRACJA.PL.
- Information collected by means of cookies makes it possible to adapt services and content to individual needs and preferences of Users, as well as to develop general statistics concerning the use of DZIECIOKRACJA.PL pages by Users. Cookies are also used to display advertisements that are most accurately matched to the User's activity on the websites.
- As a rule, cookies do not constitute personal data, although certain information in combination with other information about the User may constitute personal data. Personal information collected using cookies is collected solely for the purpose of performing certain functions for Users and is encrypted in a way that prevents unauthorized access.
- The Administrator uses, as a rule, two types of cookies - "session" and "permanent". Session cookies are temporary files that remain on the user's device until the user logs out, leaves the website or shuts down the software (web browser). Permanent cookies are files that remain on the user's device for the time specified in the parameters of the cookies or until the user manually deletes them.
- The following types of cookies are used within the framework of the DZIECIOKRACJA.PL websites due to their necessity for the realization of services:
- essential cookies, enabling the use of services available within the pages, e.g. authentication cookies used for services requiring authentication; enabling security, e.g. used to detect abuse of authentication
- statistical cookies, enabling the collection of information about the use of the websites, helping to understand how different Users behave on the site;
- preference cookies, enabling "remembering" user-selected settings and personalizing the user interface;
- marketing cookies, allowing to provide users with advertising content tailored to their interests.
- Sites in the DZIECIOKRACJA.PL domain use cookies on the basis of consent, except when cookies are necessary for the proper provision of electronic services.
- Cookies that are not necessary for the proper provision of the electronic service are blocked until you consent to the use of cookies. During the first visit to DZIECIOKRACJA.PL, the User has the possibility to decide which cookies he or she agrees to by checking the checkbox . The User can independently and at any time change the cookie settings of DZIECIOKRACJA.PL by clicking on "Your consent to cookies". The button is located at the bottom of the page in the "CHILDREN'S CARE" section.
- In addition, you may independently and at any time change your cookie settings, specifying the conditions for storing and accessing cookies on your device within your web browsing software (web browser). The User may change the settings referred to in the preceding sentence through the settings of his/her web browser. These settings can be changed, in particular, in such a way as to block the automatic handling of cookies in the settings of the web browser or to inform about the placement of cookies on the User's device each time. - The User may, at any time, object to or revoke his/her consent for cookies that are not necessary for proper provision of the service electronically, by changing the settings of cookies within DZIECRACJA.PL or by changing the settings of the software - Internet browser. You may also change the settings for individual cookies of Trusted Partners, according to the information provided by them in their privacy policies.
